O R D E R

The present writ petition has been filed seeking mandamus directing the respondents university to publish third year L.L.M. examinations result of the petitioner with roll No.2581701109, which was held in September 2020.

2. The petitioner herein had joined three year L.L.M. course in the academic year 2017-18 in the respondents university through distance education mode. The petitioner has appeared in Personal Contact Programme for the first year and he has appeared in the written examinations also. He has also appeared in the second year Personal Contact Programme in April 2019 and appeared in the written examinations in May 2019.

3. While in the third year, the Personal Contact Programme was about 2/8

to be conducted in April 2020, due to Covid-19, the respondents university directed the students to appear in the Personal Contact Programme through online mode in May 2020. However, the petitioner did not attend the same through online. However, the petitioner appeared in the third year written examinations, which were conducted in September 2020. Thereafter, the petitioner was permitted to appear in the Personal Contact Programme for the third year in May 2023. After appearing in the Personal Contact Programme for third year in May 2023, the petitioner has made representation requesting the respondents university for the publication of his result. Since there was no response, the present writ petition has been filed.

The learned counsel appearing for the respondents university, relying upon the brochure of the university for the distance education, submitted that the petitioner has to appear in the Personal Contact Programme before appearing in the written examinations. However, the petitioner had appeared in written examinations in September 2020 without appearing in the online Personal Contact Programme. Therefore, the petitioner's result for third year cannot be released.

5. Heard both sides and perused the records.

6. Due to extraordinary circumstances, the Personal Contact Programme as well as written examinations for third year L.L.M course were conducted by the respondent university through online mode. Though the petitioner has not appeared in the Personal Contact Programme, which was conducted through online in May 2020, he was permitted to appear in the online written examinations in September 2020. In case if the respondents university had strictly adhered on their brochure, they should not have permitted the petitioner to appear for the written examinations in September 2020.

7. The petitioner has lodged a complaint to the C.M. Special Cell with regard to the non-releasing of the result. The respondents university through communication dated 04.05.2021 had informed the petitioner that results for May 2020 examinations have already been published. In fact, this is contrary to the facts.

8. When the Personal Contact Programme and written examinations 4/8

were conducted through online mode contrary to the brochure due to Covid-19, the respondent university cannot stick on to their conditions laid down in the brochure.

In view of the abovesaid facts, the respondents are directed to publish the result of the writ petitioner for his appearance in September 2020 written examinations for third year L.L.M. examinations with roll No. 2581701109. This exercise shall be completed within eight (8) weeks from the date of receipt of a copy of this order.
