Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 13.12.2021 and to make mutation entry of his father's name Krishnasamy Naicker in the Village Register, Taluk Register and other revenue records with regarding to the property for an extent of 98 cents in Survey No.24/6 (Jameen Adangal Survey No.141) situated at Melapatti Village, Sivalarpatti Revenue Village, Vilathikulam Taluk, Thoothukudi District, within the time stipulated by this Court. O R D E R
*********** This writ petition has been filed for a Mandamus seeking for a direction to the respondents to consider the petitioner's representation dated 13.12.2021 seeking to mutate the entry of his father's name viz., Krishnasamy Naicker, in the Village Register, Taluk Register and other revenue records with regard to the property measuring an extent of 98 cents in Survey No.24/6 (Jameen Adangal Survey No.141) situated at Melapatti Village, Sivalarpatti Revenue Village, Vilathikulam Taluk, Thoothukudi District, within a time frame to be fixed by this Court.
2.The petitioner seeks for mutation of entry of his father's name in the revenue records and he has given a representation to that effect on 13.12.2021. Admittedly, till date the said representation has not been considered. Hence, this writ petition has been filed.
3.No prejudice would be caused to the respondents, if the petitioner's representation is considered on merits and in accordance with law.
4.Accordingly, this Court directs the fourth respondent to consider the petitioner's representation dated 13.12.2021 seeking for mutation of entry of his father's name Krishnasamy Naicker in the Village Register, Taluk Register and other revenue records with regard to the property measuring an extent of 98 cents in Survey No.24/6 (Jameen Adangal Survey No.141) situated at Melapatti Village, Sivalarpatti Revenue Village, Vilathikulam Taluk, Thoothukudi District and pass final orders on merits and in accordance with law, after hearing other necessary parties if any, within a period of twelve weeks from the date of receipt of a copy of this order.
5.With the aforesaid direction, this Writ Petition is disposed of. No costs.
