PRAYER : FOR BAIL IN CRIME NO.2 OF 2024 ON THE FILE OF THE RESPONDENT POLICE.
ORDER : The Court Made the following order :- The petitioners/A1 and A2, who was arrested and remanded to judicial custody on 06.01.2024 for the offences punishable under Sections 392 r/w 397 of IPC, in Crime No.2 of 2024, on the file of the respondent police, seek bail. 2.The case of the prosecution is that due to previous enmity, on 05.01.2024 at 1/3
about 10.00 p.m., the accused persons threatened the defacto complainant with a knife and took a sum of Rs.2,000/- from him. Hence the case. 3.The learned counsel for the petitioners would submit that the petitioners did not commit any offence as alleged by the prosecution and they are in judicial custody since 06.01.2024 and hence, he prays for grant bail to the petitioners. 4.The learned Additional Public Prosecutor would submit that the first petitioner is a history sheeter and apart from this case, the first petitioner has seven previous cases and the second petitioner has five previous cases. Hence, he strongly opposed to grant bail to the petitioners.
5.Considering the above facts and circumstances of the case and also considering the facts that the first petitioner is having seven previous cases and the second petitioner is having five previous cases, this Court is not inclined to grant bail to the petitioners.
