ORDER

This petition has been filed seeking a direction to the respondents 1 and 2 to give adequate police protection to the life and limb of the petitioner.

The learned counsel appearing for the petitioner submitted that already a civil suit in OS No.496 of 2022 has been filed by the petitioner as against the private respondents on the file of the Sub Court, Dindigul, in which an interim injunction has been ordered in favour of the petitioner restraining the private respondents herein from interfering with the peaceful possession and enjoyment of the subject property in the suit. In this regard, the petitioner sent a representation seeking for police protection. However, there is no action from the respondent police. Hence, this petition came to be filed.

The learned Government Advocate appearing for the respondent police submitted that after receiving the complaint, the respondent police conducted an enquiry, wherein both the petitioner as well as the private respondents were advised to give an undertaking to work out their remedy before the appropriate civil forum. However, the petitioner refused to give such an undertaking.

4. Heard the learned counsel on either side and carefully perused the materials placed before this Court. Since no adverse order is proposed to be passed against the private respondents, notice to them is dispensed with.

5. If the private respondents are continuing to disturb the peaceful possession and enjoyment of the petitioner's property, the petitioner is directed to produce a copy of the order of granting interim injunction to the second respondent police. On considering the same, the second respondent police is directed to initiate action in accordance with law, if necessary.

6. With the above direction, this criminal original petition stands disposed of.
