ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Section 6(4) of TNSC (RDCS) Order 1982, r/w. Section 7(1)(a)(ii) of Essential Commodities Act, 1955 , in Crime No.28 of 2024, seek anticipatory bail.
2.The case of the prosecution is that the petitioners and the other accused persons illegally transported 566 bags of PDS rice. Hence, the complaint. 3.The learned counsel appearing for the petitioners would submit that the petitioners did not commit any offence as alleged by the prosecution and they have been falsely implicated in this case. He would further submit that the accused No.9 has been granted anticipatory bail by this Court in Crl.O.P(MD).No.1383 of 2024. Hence, he prays for grant of anticipatory bail to the petitioners. 4.The learned Government Advocate (Crl.side) appearing for the respondent Police would submit that the petitioners are A2 and A3 and they are the main accused persons for illegal transportation of PDS rice and unless the petitioners surrender before the respondent Police, it would not be possible for completing the investigation and the petitioners are having four previous cases.
5. Considering the facts and circumstances of the case and the serious allegations levelled against the petitioners, this Court is not inclined to grant 2/3
anticipatory bail to the petitioners.
