PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the first and second respondents to restore the classification of land in S.No.406/1AT situated at Poiyundarkottai Village, Orathanadu Taluk, Thanjavur District as 'Public Pathway' in all revenue records and cancel the patta No.1232 in respect of S.No.406/1AT by considering the petitioner's representation dated 19.07.2025 within stipulated time as fixed by this Court. ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner seeks a direction to the first and second respondents to restore the classification of land in S.No.406/1AT situated at Poiyundarkottai Village, Orathanadu Taluk, Thanjavur District as 'Public Pathway' in all revenue records and cancel the patta No.1232 in respect of S.No.406/1AT by considering the petitioner's representation dated 19.07.2025.

2.The contention of the petitioner is that in the revenue records initially, the property in Survey No.406/1AT was classified as public pathway. The private respondents have encroached upon the said property and managed to obtain patta for the said land. Therefore, the petitioner seeks to restore the classification of the land as public pathway. 3.The learned Additional Government Pleader appearing on behalf of the official respondents submits that the present writ petition is the fourth round of litigation with regard to the very same issue raised in this writ petition. Initially, a writ petition was filed by one Tamilmaran in W.P.(MD)No.5667 of 2025 for the very same relief and the same has been dismissed by this Court by an order dated 18.03.2025. The petitioner is none other than the niece of the said Tamilmaran.

Further, similar other writ petitions have been filed in W.P.(MD)Nos.15518 of 2021, & 17897 of 2022 in this regard and the same have also been dismissed stating that patta has already been granted by the authorities to the occupiers of the property and as a matter of right the petitioners cannot seek to restore the classification.

4.In view of the above submission, we do not find any merits in this writ petition. Accordingly, this writ petition is dismissed. It is for the petitioner to challenge the patta proceedings, if so advised, in accordance with law before the revenue authorities. There shall be no order as to costs.
