ORDER : The Court Made the following order :- This petition has been filed by the petitioner/ accused no. 6 seeking bail for the alleged offence under Sections 399 of IPC r/w.26(2) of Indian Arms Act

2. Heard both sides

3. The learned counsel for the petitioner would submit that the petitioner was arrested and remanded to judicial custody on 26.04.2019 and he is in custody. He would also submit that a false case has been foisted against the petitioner. He would also submit that co- accused in this case were granted bail.

4. The learned Additional Public Prosecutor would submit that the petitioner along with other accused planned to make a theft in jewellery shop. He would also submit that there are eleven previous cases pending against the petitioner and he is a habitual offender. Hence he opposed to grant bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and also considering the fact that there are 11 eleven cases pending against the petitioner of similar nature, this Court is not inclined to grant bail to the petitioner.
