RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to pass an order to extend the time granted in Crl.O.P.(MD)No. 24056 of 2016 dated 29.12.2016 and pass such further or other orders as this Honourable Court may deem fit and proper in the above Circumstances of the case.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.K.R.LAXMAN, Advocate for the petitioner and MR.P.KANDASAMY Government Advocate (Crl.Side) for the Respondent the court made the following order:- Heard both sides.

2. The petitioner was directed to surrender before the learned Judicial Magistrate, Paramakudi and to file a petition for recalling the warrant within 10 days from the date on which the order copy is made ready and the learned Magistrate is directed to consider the same on the same day and pass orders on merits and in accordance with law as ordered by this Court in Crl.O.P.(MD).No.24056 of 2016, dated 29.12.2016. The petitioner moved before this Court for anticipatory bail, since Non-Bailable Warrant issued against him is pending. The petitioner has failed to comply the conditional order of this Court.

3. The learned counsel for the petitioner states that the petitioner is suffering from viral fever and he is unable to surrender before the concerned court.

4. Considering the above reasons, this Court is inclined to extend the time. Accordingly, time for compliance is extended for a period of 10 days from the date on which the order copy is made ready.
