Mr.R.Meenakshi Sundaram, Additional Public Prosecutor Prayer: This Petition is filed under Section 430(3) r/w 530 of BNSS praying to relax the condition which was imposed by this Court in Crl.M.P.(MD)No.11415 of 2023 in Crl.A.(MD)No.704 of 2023 dated 31.10.2023 directing to sign before the Trial Court on the first working day of every English calender month at 10.30 a.m.

ORDER

This petition is filed to relax the condition which was imposed on the 1/3

petitioner in Crl.M.P.(MD)No.11415 of 2023 in Crl.A.(MD)No.704 of 2023 dated 31.10.2023.

2. The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner / appellant has been complying the condition from 31.10.2023 without fail.

3. It is reported that the petitioner / appellant is affected with paralysis and with great difficulty he is reporting once in a month before the Court to comply the condition.

4. Considering the health ground of the petitioner / appellant and his conduct in complying the condition without fail for several months, I feel the condition imposed on him can be relaxed.

5. Accordingly, the condition No.9(iii) already imposed on the petitioner in Crl.M.P.(MD)No.11415 of 2023 in Crl.A.(MD)No.704 of 2023 dated 31.10.2023 is hereby relaxed.
