Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(3), 14(1)(a) of TNSC (RDSC) Order 1982, r/w 7(1)(a)(ii) of E.C. Act 1955, in Crime No.328 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner is working as salesman in the Ration shop at Allangudi Mahajanam and Mullal attached to Allangudi Mahajanam Primary Agri Co-operative Credit Society. At the time of Inspector by the Co-operative Sub Registrar (PDS) along with Secretary, there was a stock deficit of Rs.8853.50/- in Allangudi Mahajanam shop and Rs.7062.25/- in Mullal shop. The total deficit is Rs.15915.75/-.
3.The learned counsel for the petitioner submitted that the petitioner is working as a salesman and on 09.05.2015 he fell down unconsciously due to his blood sugar and hypertension and his wife has brought the petitioner to the hospital after handing over the key to the Secretary of the Society. The petitioner has already paid a sum of Rs.43,274.40 as per the G.O., and therefore, there is no loss to the Society. He further submitted that the petitioner has earlier filed a petition in Crl.O.P.((MD)No.19390 of 2015 at that time, the learned Government Advocate (Crl.side) submitted that no case was registered against the petitioner.

5.Considering the facts and circumstances of the case and also considering the fact that the petitioner has already paid a sum of Rs.43,274.40/- to the Society, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.VI, Trichy and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
