Petitioner PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the H.M.O.P.No.293 of 2022 on the file of the 2nd Additional Sub Court, Coimbatore and transfer the same to the Family Court, Madurai.

ORDER

The present transfer civil miscellaneous petition has been filed to transfer H.M.O.P.No.293 of 2022 from the file of the 2nd Additional Sub Court, Coimbatore to the Family Court, Madurai. 1/4

2. There is no representation on behalf of the petitioner.

3. Though the respondent has been served, there is no appearance either in person or through counsel. The name of the respondent is also printed in the cause list.

4. The petitioner in her affidavit filed in support of the petition stated as follows:

"6. I respectfully submit that I am a women and I am living at Villapuram, Madurai. No one can take care of me to pay the travelling expenses from Madurai to Coimbatore. Under these circumstances, I have to be accompanied from Madurai to Coimbatore is in question. Moreover I have no employment either in the Government Sector or private sector.

7. I respectfully submit that I have to appear before the learned 2nd Additional Sub Court, Coimbatore for each and every hearing. I have no means for survival except my parents income. I am starving for my day to day affairs and no one come forward for taking care of me. I am living under poverty and the respondent has not at all given any maintenance to me."

5. Considering the above, I am inclined to allow the present Transfer Civil Miscellaneous Petition. Thus, the present Transfer Civil Miscellaneous Petition stands allowed by transferring H.M.O.P.No.293 2/4

of 2022 from the file of the 2nd Additional Sub Court, Coimbatore to the file of the Family Court, Madurai. No costs. Consequently, connected miscellaneous petition is closed.
