PETITION FOR BAIL Under Sec.439(i)(b) of Cr.P.C. PRAYER :- To modify the order dated 28.03.2019 in Cr.M.P.No.1602 of 2019 on the file of the Honourable Principal Sessions Judge, Tiruchirappalli, relating to condition imposed against the petitioner for produce official sureties for enlarge the petitioner on bail in the case in Cr.No.416 of 2018 on the file of the respondent.

ORDER : The Court Made the following order :- This petition has been filed to modify the order dated 28.03.2019 in Cr.M.P.No.1602 of 2019 on the file of the Honourable Principal Sessions Judge, Tiruchirappalli, relating to condition imposed against the petitioner for produce official sureties for enlarge the petitioner on bail in the case in Cr.No.416 of 2018 on the file of the respondent.

2. The learned counsel for the petitioner would submit that the petitioner was arrested and remanded to judicial custody on 11.01.2019. He would further submit that the learned Prinicipal Sessions Judge, Tiruchirappalli by an order dated 28.03.2019 in Crl.M.P,No.1602 of 2019 granted bail to the petitioner on condition to produce official sureties to enlarge the petitioner on bail in crime number 416 of 2018. He further submit that no official sureties is ready to give surety for the petitioner herein. Therefore he is in judicial custody from 11.01.2019. Hence, he prays to modify the condition.

3. The learned Government Advocate (Crl.Side) would submit that the petitioner is having nine previous cases of similar nature and he is a habitual offender. Hence she opposed to modify the above condition.

4. Considering the submissions made on either side and also considering the period of incarceration, the condition imposed by the learned Prinicipal Sessions Judge, Tiruchirappalli by an order dated 28.03.2019 in Crl.M.P,No.1602 of 2019 is modified to the effect that the petitioner shall execute a bond for a sum of 10,000/- (Rupees Ten thousand only) with two blood related sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.VI, Trichy.
