Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of writ of mandamus, directing the respondents particularly the fourth respondent to disburse the gratuity amount of Rs.1,77,741/- with 10% interest as per the order in P.G.No.58 of 2018 on the file of the second respondent by initiating revenue recovery proceedings through the second respondent against the fourth respondent to collect the gratuity amount with interest as fixed by the third respondent for the petitioner till the date of payment and disburse the same to the petitioner within time stipulated by this Court.

By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.

2. The learned Special Government Pleader appearing for the respondents would submit that for the purpose of considering the petitioner request made in the representation dated 23.12.2019, the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.3387 of 2020 petitioner is required to furnish the legal heirship certificate of the late employee, which the petitioner has not submitted. 3.The learned counsel for the petitioner would submit that the petitioner is willing to submit the legal heirship certificate. 4.In the light of the above submissions made by the respective counsels, there shall be a direction to the fourth respondent herein to consider the petitioner's representation dated 23.12.2019 within a period of four weeks from the date on which the petitioner submits the legal heirship certificate of Late K.Somupillai. It is made clear that this Court has not expressed any of its view with regard to the claim made by the petitioner in her representation and it is for the fourth respondent to consider it in accordance with law.
