ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.6, in Crime No.1085 of 2015 on the file of the respondent police, was arrested on 22.09.2015 for the alleged offence punishable under Sections 147, 148, 341 and 302 of I.P.C., and hence, seeks bail.

2. The case of the prosecution is that on 21.09.2015, at about 11.50 a.m., near Dindigul Union Office, the petitioner and others assembled unlawfully with deadly weapons and restrained the deceased Raja @ Jesuraja, who came to the Court for appearing the case, and cut him with knife all over the body and caused his death and threatened the witnesses.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he is no way connected with the alleged offence and the petitioner was arrested on 22.09.2015 and they are in custody for more than 44 days.

4. The learned Government Advocate (Crl.side) submitted that the investigation is pending and the other accused are arrested and they are still in custody and if the petitioner is released on bail, there is a possibility of tamper the witnesses and hamper the investigation.

5. Considering the gravity of the offence, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
