O R D E R

This petition has been filed seeking a direction to the second respondent not to harass the petitioner under the guise of enquiry.

2. The grievance of the petitioner is that based on the complaint given by the third respondent, the second respondent asked the petitioner to appear for enquiry. Alleging that the second respondent is harassing the petitioner under the guise of enquiry, the present petition has been filed.

3. Today, when the matter was taken up for hearing, the learned Government Advocate (Criminal side) appearing for the respondents 1 and 2, on instructions, submitted that based on the complaint given by the third respondent, petition enquiry is pending against the petitioner and only for the purpose of enquiry, he was called for, but, without appearing for enquiry, the petitioner has filed the present petition seeking the aforesaid relief.

4. Considering the fact that the complaint is pending, the petitioner is directed to appear before the second respondent for the purpose of enquiry and in the course of investigation, the second respondent is directed not to harass the petitioner under the guise of enquiry.

5. This Criminal Original Petition is disposed of accordingly.
