ORDER : This Civil Miscellaneous Petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.K.RAMAIAH, Advocate for the petitioner and of MR.P.PARANTHAMAN, Advocate on behalf of the Respondent, the court made the following order:- 1/3

This petition is filed seeking an order of stay the operation of award dated 02.02.2023 made in M.C.O.P.No.165 of 2020 on the file of the Motor Accident Claims Tribunal/Special Sub Judge, Tiruchirappalli.

2.This Court, by order dated 09.07.2024, granted an order of interim stay on condition that the appellant shall deposit 50% of the award amount to the credit of M.C.O.P.No.165 of 2020 on the file of the Motor Accident Claims Tribunal/Special Sub Judge, Tiruchirappalli, on or before 03.09.2024. 3.Today, when the matter is taken up for hearing, the learned counsel appearing for the appellant submits that the appellant has not complied with the order of this Court dated 09.07.2024.

4.Since the appellant has not complied with the order of this Court dated 09.07.2024, the petition in C.M.P.(MD)No.8506 of 2024 is dismissed for noncompliance and interim stay granted by this Court, by order dated 09.07.2024, is hereby vacated.
