ORDER

This Criminal Original Petition has been filed seeking for transfer of investigation in Crime No.274 of 2020 from the file of the second respondent to the file of the third respondent. 2.The learned Additional Public Prosecutor appearing for the respondents would submit that the second respondent already completed the investigation and action dropped in Crime No.274 of 2020. The copy of the Referred Charge-sheet notice was also sent to the petitioner.

3.However, the learned counsel appearing for the petitioner submitted that the second respondent colluded with the real accused and mechanically closed the FIR as action dropped without https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.2944 of 2022 considering the representation sent by the petitioner. Further, the petitioner did not receive any referred charge-sheet notice till today.

4.Considering the above, the second respondent is directed to serve the copy of the Referred Charge-sheet notice to the petitioner within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the petitioner is at liberty to file a protest petition before the concerned Jurisdictional Magistrate in the manner known to law, if she is so advised.
