PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to direct the 1st Respondent to give suitable direction to the 3rd Respondent not to harass the Petitioner at the investigation of the Respondent No.4 by considering the Petitioner representation dated 03.02.2024 within the period as stipulated by this Court. 1/5

O R D E R

The learned Counsel for the Petitioner submits that the Petitioner is a tenant under the fourth Respondent and there had been dispute regarding tenancy. While so, the fourth Respondent had approached the third Respondent and the third Respondent had summoned the Petitioner. Therefore, the Petitioner had approached this Court seeking directions against the Respondents 1 to 3 not to harass the Petitioner. 2.The learned Government Advocate (Crl.side), on instructions of the Respondents 1 to 3, would submit that based on the complaint of the tenant, CSR No.38 of 2024 was registered against the Petitioner. On the complaint of the landlord, no CSR was registered. In CSR.No.38 of 2024, the fourth Respondent was summoned, heard and enquired. At that time, both the parties gave an undertaking that they will sort out the dispute through Civil Court. Therefore, both the complaints were closed. He would further submit 2/5

that the Police are abide by the circular of the Director General of Police, Head of Police Force, Tamil Nadu State, Chennai -4 issued in Rc.No. 892914/X1/2020 dated 12.03.2021 and the circular of the Additional Director General of Police, Chennai, issued in C.No.18/ADGP/L & O/Camp/2024 dated 09.01.2024.

3.Since it is made clear in the circular of the Director General of Police, Head of State Police Force, Tamil Nadu State, Chennai -4 issued in Rc.No.892914/X1/2020 dated 12.03.2021 that the Field Officers shall not entertain any dispute regarding property and money, the undertaking given by the learned Government Advocate (Crl.side), is recorded. Accordingly, this Criminal Original Petition is closed.
