PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents to accept the pension proposal submitted by the fourth respondent and thereby direct them to revise the petitioner's pension based on his last drawn pay of Rs.1,98,700/- by taking account of the G.O.Ms.No.61, Higher Education (H1) Department, dated 08.03.2023 as well as his representation dated 20.06.2023. Heard, the learned Counsel for the petitioner, Mr.Siddharthan, learned Additional Government Pleader and the learned Standing Counsel for the fifth respondent and perused the material available on record. Inspite of service of notice, there is no representation on the side of the fourth respondent. 2.This writ petition has been filed seeking a Writ of Mandamus to direct the respondents to accept the pension proposal submitted by the fourth respondent and for further direction to revise the petitioner's pension based on his last pay drawn of Rs.1,98,700/- in terms of G.O.Ms.No.61, High Education 2/6

(H1) Department, dated 08.03.2023, by considering the representation dated 20.06.2023.

During the course of hearing, the learned Additional Government Pleader basing on written instructions from the third respondent, submits that employees who are working in all the Government aided Institutions, those employees pension and revised pension proposals will be received through the Principal of the concerned college and thereafter it will be referred to the Accountant General, by the Regional Joint Director of Collegiate Education.

4. In the present case, no revised pension proposals have been received from the fourth respondent college. Taking into consideration of the submissions of the learned Additional Government Pleader, it appears that the fourth respondent college did not sent proposals to revise the petitioner's pension to the third respondent till now.

5. Therefore, it is for the petitioner to approach the fourth respondent to request him to sent the proposal to the third respondent. Thereafter, the third respondent forward it to the fifth respondent. 3/6

6. In view of the above facts and circumstances, in our considered view that this writ petition can be disposed of with a direction to the petitioner to approach the fourth respondent to sent proposal to revise his pension.

7. Accordingly, this writ petition is disposed of. The petitioner is at liberty to approach the fourth respondent seeking to sent proposal to revise his pension, in terms of G.O.Ms.No.61, Higher Education (H1) Department, dated 08.03.2023.

There shall be no order as to costs.
