PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus calling for the records in pertaining to the impugned order of the 3rd respondent vide his proceedings Nil dated 09.01.2026 and quash the same as illegal and consequently directing the 3rd respondent not to evict the petitioner from survey number 175 situated at Elamanam Village, Manapparai Taluk, Trichy District, without following any due process of law by considering his objection dated 10.12.2025. [Order of the Court was made by DR.G.JAYACHANDRAN, J.] This writ petition has been filed challenging the eviction notice, dated 09.01.2026, issued by the third respondent, in respect of the land comprised in Survey No.175 of Elamanam Village, Manapparai Taluk, Trichy District.

2. Today, when the matter is taken up for hearing, Mr.J.Ashok, learned Additional Government Pleader, who takes notice for the respondents, on instructions, submits that the survey number of the land, which is in illegal occupation of the petitioner herein is 142 and not 175 and hence, the authority concerned has proposed to withdraw the impugned notice and issue a fresh eviction notice with correct survey number.

3. Recording the proposal of withdrawal of the impugned notice citing error in the survey number, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. [G.J., J.] [K.K.R.K., J.] 03.02.2026 NCC :
