JUDGMENT

(By G.R.SWAMINATHAN, J.) Heard both sides.

2.The writ petitioner was working as Typist in the second respondent college. He was appointed as Lab Assistant, when vacancy arose in the said post. The proposal was submitted to the Joint Director of Collegiate Education, Madurai for approving the appointment. Vide order dated 20.05.2022, the proposal was rejected. Challenging the same, W.P.(MD)No. 16106 of 2022 was filed. The learned single Judge allowed the writ petition vide order dated 28.08.2024. Aggrieved by the same, the State has filed this writ appeal. 2/4

3.The learned single Judge had only followed the earlier order of the Hon'ble Division Bench. The post of Lab Assistant and the post of Typist are carrying the same scale of pay. Therefore, there is no financial implication for the State. There is also no rival claim. In this view of the matter, we do not want to interfere with the order of the learned single Judge. 4.This Writ Appeal stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
