PRAYER: This Transfer Civil Miscellaneous Petition filed under Section 24 of Civil Procedure Code, to withdraw the case in HMOP.No.07 of 2022 on the file of the Subordinate Court, Paramakudi and transfer the same to any other Court in Madurai District. O R D E R

This petition is filed to withdraw the case in HMOP.No.07 of 2022 from the file of the Subordinate Court, Paramakudi and transfer the same to any other Court in Madurai District. 2.The learned counsel for the petitioner submitted that HMOP.No.07 of 2022 was filed by the respondent/husband, for seeking restitution of conjugal rights before the Subordinate Court, Paramakudi. Since the petitioner is residing at Madurai along with three years old child, she cannot go to Paramakudi to attend the Court hearings. Hence, she seeks to transfer the case as prayed for.

3.Considering the facts and circumstances of the case and also considering the submission made the learned counsel for the petitioner, HMOP.No.07 of 2022 is ordered to be withdrawn from the file of the Subordinate Court, Paramakudi and transferred to the file of Family Court, Madurai. The learned Judge, Family Court, Madurai is directed to send the cases to Mediation Centre after that the trial can be proceeded with.
