Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners/accused Nos.5 & 6, who were arrested and remanded to judicial custody on 23.10.2015 for the alleged offences punishable under Sections 147, 148, 364-A and 506(ii) IPC in Crime No.1383 of 2015 on the file of the respondent police and hence, seek bail. 2.The case of the prosecution is that on 21.10.2015, the son of the defacto complainant was kidnapped by A1 with the help of other accused persons and demanded a sum of Rs.1,00,000/-. Hence, the present complaint.

3.The case of the petitioner is that the son of the defacto complainant and A1 were close friends and there was a dispute with regard to money transaction, due to which, a false complaint has been given.

4.The learned Government Advocate (crl. side) would submit that the petitioners are the relatives of A1 and on the confession given by the petitioners, other accused were arrested and the case is posted to 17.11.2015 for recording the statement of the victim and his father under Section 164 Cr.P.C. and objected to grant bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5.Considering the facts and circumstances of the case and also considering the fact that the case is posted to 17.11.2015 for recording the statement of the victim under Section 164 Cr.P.C., I am not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
