PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to pay EL Surrender Leave Salary with 6 % interest from the date of retirement to the date of actual payment within a time frame as may be fixed by this Court.

The petitioner has approached this Court seeking a direction to the respondent to settle his EL Surrender Leave Salary with 6 % interest from the date of his retirement to the date of actual payment within a stipulated time.
2.The case of the petitioner is that he joined as a Driver in the respondent Transport Corporation on 02.01.1996 and retired from service as a Special Grade Driver on 29.02.2024. According to him, he is entitled for encashment of surrendered earned leave. However, surrendered leave benefit has not been settled to him and therefore, he has submitted a representation to the respondent and filed the present writ petition.
3.Mr.S.C.Herold Singh, learned Standing Counsel takes notice for the respondent and submits that in the event, if the petitioner is eligible, it would be calculated and disbursed to the petitioner within a reasonable time.

4.This Court paid its anxious consideration to the rival submissions made and also perused the materials placed on record. 5.Admittedly, the petitioner has rendered service in the respondent Corporation from the year 1996 till 2024. While disbursing the retirement benefits, it appears that the benefit of earned leave surrendered by the petitioner has not been settled to him. Therefore, this Court directs the respondent to disburse the amount for the earned leave surrendered to the petitioner together with 6% interest, from the date of retirement till the date of actual disbursement, within a period of eight weeks from the date of receipt of a copy of this order, if not settled already.
