ORDER : The Court Made the following order :- The petitioner, who arrayed as accused No.1, in Crime No.482 of 2015 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 3(1),3(2)(a) and 5(1) of the Immoral Traffic Prevention Act, 1956 and hence, seeks anticipatory bail. 2.The case of the prosecution is that the Petitioner along with other accused person said to have committed the offence punishable under Sections referred to above.

3.The learned counsel for the Petitioner submitted that the Petitioner is innocent and that the Petitioner has not committed any offence as alleged by the prosecution and due to vengeance only, the Petitioner's name has been implicated in this case. 4.The learned Government Advocate(Crl.side) on instructions would submit that the Petitioner has already filed Crl.O.P.No.21124 of 2015 mentioning his name as Raju @ Bharathiraja, as if he was arrayed as https://hcservices.ecourts.gov.in/hcservices/ accused No.1, by the respondent Police and the said case has been withdrawn by him on 4.10.2015. There is no change in the circumstances,

except the change in the name of the Petitioner as Raju @ Sheik. 5.Considering the facts and circumstances and considering the fact that the Petitioner has already withdrawn the Petition in Crl.O.P.No.21124 of 2015 filed by him for the same relief and as there is no change in the circumstances, this Criminal Original Petition is liable to be dismissed and according the same stands dismissed. sd/- 24/11/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
