Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 3rd respondent to conduct fair and transparent public auction (Fishing) immediately for the fasali year 2022-2023 for the lakes namely, Vellkulam and Pethakulam situated in Arasarkulam West Village, Aranthangi Taluk, Pudukkottai District on the 1/4

basis of the petitioner representation dated 03.01.2023 with video recording in order to prevent the Unnecessary Activities such as Undue Influences and Political pressure in the Public Auction within the time that may be stipulated by this Court.

ORDER

Heard the learned counsel on either side.

2.The only request made in the writ petition is that transparent public auction must be held in respect of the petition mentioned fishery rights. No exception can be take to the said request.

3.The learned Additional Government Pleader submitted that on 17.02.2023 at around 12.00 noon, the auction will be conducted. The respondents 2 and 3 are directed to ensure that wide publicity is given to said auction during the intervening period also apart from the publicity already made. The second respondents 2 and 3 would also ensure that the entire 2/4

proceedings are videographed. Upset price has already been fixed. The respondents 2 and 3 will endevaour to issue license in favour of the highest bidder. If necessary police aid can also be taken to ensure that there is full and free participation by all the intending bidders. 4.The writ petition is allowed accordingly.
