ORDER : The Court Made the following order :- This Complaint has been registered by the police pursuant to the written complaint lodged before the District Registrar after obtaining necessary opinion.
2. It is seen that this petitioner is a document writer and he has presented nine documents for registration and they were registered. During investigation, it was found that the computer generated patta and other documents that were kept along with the documents intended for registration were fabricated documents and the matter has gone upto the Collectorate for enquiry. When this matter came to light, legal opinion was obtained as stated above and this complaint was given.
3. The learned counsel for the petitioner would submit that the beneficiary has not come forward to lodge any complaint and therefore, this petitioner will be entitled for anticipatory bail.
4. I am unable to persuade myself to agree with the submission because criminal law can be set in motion by any one, especially when a https://hcservices.ecourts.gov.in/hcservices/ cognizable offence is said to have been committed. Here, during
investigation, it was found that the documents annexed for registration were bogus documents. Hence, custodial interrogation of the petitioner is necessary to find out how the Government Records were fabricated and also the bogus seals should be recovered.
