ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 143,188 and 341 of IPC in Crime No.733 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2. The case of the prosecution is that on 21.09.2015 at about 7.00 am, while some persons were conducing procession of Vinayakar Chadurthi rally, there was a melee arose between two groups and therefore, the petitioners blocked the road and conducted a road roko.
3.It is submitted by the learned counsel for the petitioners that the petitioners are innocent persons and they have not committed any offence and they have been falsely implicated in this case and prays for anticipatory bail in favour of the petitioners. https://hcservices.ecourts.gov.in/hcservices/
4.It is submitted by the learned Government Advocate (Crl.Side) that the investigation of the case is pending. He further submitted that A2 to A8 were already arrested and enlarged on bail. 5.Considering the facts and circumstances of the case and also considering the fact that the co-accused were already arrested and released on bail, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Aruppukkottai, Virudhunagar District and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m., until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6.
