O R D E R

When this Court expressed that the points raised by the petitioner are factual in nature and cannot be adjudicated in this quash petition, the learned counsel for the petitioner sought permission of this Court to withdraw this Criminal Original Petition.

2. However, the learned counsel for the petitioner would submit that the first respondent has violated the earlier order of this Court dated 29.11.2019 in Crl.O.P.(MD) No.17711 of 2019, wherein the first respondent was directed to complete the investigation and file the final report within a period of three weeks from the date of receipt of a copy of that order; and that although the case is pending from 2017, the first respondent has not chosen to file the final report, even as per the directions of this Court.

3. The learned Government Advocate (Criminal Side) for the first respondent would submit that subsequently, the case was transferred to the Central Crime Branch, Madurai, and renumbered as Crime No.35 of 2024; and that the investigation is still pending. Page No. 2 of 5

On a perusal of the earlier order of this Court dated 29.11.2019 in Crl.O.P.(MD) No.17711 of 2019, it is clear that the first respondent, namely, the Inspector of Police, Thallakulam Police Station, Madurai City, has violated the directions issued by this Court, as the case was transferred only after five years from the date of the said order.

5. The Commissioner of Police, Madurai City, shall take departmental action against the Inspector of Police, Thallakulam Police Station, who is responsible for the violation of the direction of this Court, and file a report before this Court within a period of four weeks from today.

6. The Inspector of Police, Central Crime Branch, Madurai, shall complete the investigation within a period of four weeks from today, failing which the petitioner is at liberty to file a fresh quash petition, besides filing a contempt petition against the Inspector of Police, Central Crime Branch, Madurai.

7. With the above observations, this Criminal Original Petition is dismissed as withdrawn. Consequently, the connected Miscellaneous Petitions are closed.
