ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 174 Cr.P.C., altered into 306 of IPC, in Crime No.616 of 2015 on the file of the respondent police and hence, seeks anticipatory bail. 2.The case of the prosecution is that the petitioner is having illicit intimacy with so many ladies and tortured the deceased and due to which, the deceased committed suicide.
3.The case of the petitioner is that he is an innocent person and he has not committed any offence as alleged by the prosecution and his name has not been mentioned in the FIR and there is no specific overt-act against the petitioner.
4.The respondent police has filed a counter affidavit stating that the petitioner is working as a Police Constable. The marriage between the petitioner and the deceased was solemnized 7 years back and during the marriage, the deceased parents has given 100 sovereigns of gold jewels and cash Rs.1,00,000/- and the petitioner is having illegal intimacy with so many ladies and tortured the deceased and due to which, the deceased committed suicide and he is having two children. 5.Considering the facts and circumstances of the case and also considering the fact that there is no specific overt-act against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Thoothukudi and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6.
