PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS, to pass a direction to the respondents to transfer all the accrued amount derived from the Fixed Deposits (54 Nos.) as detailed in the schedule to the Savings Bank Account of the petitioner "Without Any Stigma" and granting Liberty to the petitioner to transact all the accounts as the petitioner pleases within a time frame as fixed by this Court. ORDER

The present writ petition has been filed seeking a mandamus directing the respondent Bank to transfer all the accrued amount derived from the fixed deposits which are detailed in the schedule to the savings Bank account of the writ petitioner and granting liberty to the petitioner to operate the SB account.

The learned Counsel appearing for the writ petitioner submits that one of her relatives has filed a suit in O.S.No.382 of 2025, before the Principal District Court, Madurai, wherein the savings Bank account is shown as schedule 'F'. However, the FD accounts are not the subject matter of the civil suit.

3. The learned Standing Counsel appearing for the Bank submitted that there no interim orders have been passed by the civil Court. They are not proposing to freeze the bank account or the fixed deposits of the writ petitioner. It is always open to the writ petitioner either to close the fixed deposit or operate the bank account.

Recording the above said submissions of the learned Standing Counsel appearing for the respondent Bank, the writ petition stands disposed of with a direction to the petitioner to approach the Bank either to close the FD accounts or to transfer the amount accrued in the FD account to the SB account by way of giving a personal bond or an undertaking letter as demanded by the third Respondent Bank.

5. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are also closed. 18.02.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
