ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.2 and 3, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147,148,341 and 302 of IPC in Crime No.No.65 of 2014 on the file of the respondent police and hence, seek anticipatory bail.
2. The case of the prosecution is that on 11.02.2014, the petitioner along with three other accused attacked the deceased and caused him to death. On complaint given by the de facto complainant, who is the second wife of the deceased, a case has been registered against the petitioners.
3. It is submitted by the learned counsel for the petitioners that the deceased is the husband of A1's sister and these petitioners are relatives of A1. After marriage, the deceased left her and married another woman. When this was questioned by the petitioners, the deceased attacked the petitioners with knife, as self-defence to safeguard themselves, the petitioners attacked the deceased. He further submitted that the petitioners are innocent and they have been falsely implicated in this case.
4.It is submitted by the learned Government Advocate (Crl.Side) that the petitioners along with three other accused attacked the deceased and caused death. He further submitted that the petitioners are having each one previous case.
5.Considering the gravity of offence and the also considering the fact that the petitioners are having one previous case each, this Court is not inclined to grant anticipatory bail to the petitioners.
