For Respondent : Mr.V.Neelakandan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.30/2018 on the file of the respondent police ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 149, 294(b), 324, 302 and 352 of IPC in Crime No.30 of 2018, seeks anticipatory bail.

2. Heard both sides.

3.The learned counsel appearing for the petitioner has submitted that after dismissal of the earlier application in Crl.O.P.(MD).No.15786 of 2018, a charge sheet has been filed and the case was taken on file in P.R.C.No.62 of 2019 before the learned Judicial Magistrate No.2, Ramanathapuram. He further submitted that after issuance of summons, the petitioner came to know about the aforesaid facts and also the case is pending against him and therefore he requested this court to grant of anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor appearing for the respondent has submitted that only summons has been issued to the petitioner. Hence, he opposed this petition.

5.Considering the aforesaid submission made by the learned Additional Public Prosecutor that only summons has been issued by the learned Magistrate, this Court is of the view that in such case there is no apprehension of arrest and therefore, the petitioner can appear before the concerned Magistrate 6.Accordingly, this petition is dismissed.
