ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.9, in Crime No.614 of 2013 on the file of the respondent police, was arrested on 12.08.2015 for the alleged offences punishable under Sections 5 and 7 of Immoral Traffic Prevention Act, 1956 and Sections 120(b), 366 (A), 372, 373 of I.P.C., and Sections 3 and 4 of POCSO Act, 2012 and hence, seeks bail.

2. The case of the prosecution is that the de-facto complainant, on receiving information that prostitution is carrying on in open place, visited the spot with police party and arrested the petitioner and recovered the TATA Sumo vehicle bearing registration No.TN 59 P 9691 at Kalmandapam, Maraneri Road used for prostitution.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and she has been falsely implicated in this case and she has two minor children and she is in judicial custody from 12.08.2015.

4. The learned Government Advocate (Crl.side) filed a counter affidavit stating that the petitioner is habit of approaching the minor poor girls and involved them in prostitution and all the accused persons are acted as gang and the co-accused viz., A5 to A8 and A10 were already arrested and enlarged on bail. It is further submitted that the charge sheet is ready and it is pending with the Director of Prosecution for approval.

Taking into consideration the facts and circumstances and the petitioner is in judicial custody from 12.08.2015 and the coaccused were already arrested and enlarged on bail, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Sivakasi and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. and 5.00 p.m. until further orders. sd/- 19/11/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
