Prayer in Crl.O.P.(MD) No.23368 of 2023 Criminal Original Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to call for the records pertaining to the Impugned Charge Sheet in CC.No.16 of 2021 pending on the file of Judicial Magistrate cum Additional Magistrate Court,Ramanathapuram in FIR in Cr.No.18 of 2018 on the file of the Respondent No.1 dt.18.5.2018 on the file of the Respondent No.1 dated 18.05.2018 for the alleged offences U/s. 147, 294(b), 323 of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 and quash the same against the eptitioners as illegal. THIRUMURUGAN, Advocate for the petitioner and of MR.M.VEERANTHIRAN, Additional Public Prosecutor on behalf of the Respondnt No.1, the court made the following order:- Crl.M.P.(MD)No.1536 of 2024 in Crl.M.P.(MD)No.18148 of 2023 in Crl.O.P.(MD) No.23368 of 2023 had been filed seeking to extend the time to file an undertaking affidavit to comply with the order of this Court in Crl.O.P.(MD)No.23368 of 2023 in Crl.M.P.(MD)No.18148 of 2023, dated 22.12.2023. 2.As per the order passed by this Court in Crl.O.P.(MD)No.23368 of 2023 in Crl.M.P.(MD)No.18148 of 2023, dated 22.12.2023, the Petitioners were directed to furnish undertaking affidavit by affixing their recent photographs to the effect that they will appear before the Trial Court as and when required and must ensure their proper representation through Advocate.
3.The Petitioners are Accused Nos.1 to 5 in Cr.No.18 of 2018. Since they were 2/4
unable to execute the affidavit within the time specified as per the order of this Court, dated 22.12.2023, they had filed this Miscellaneous Petition seeking extension of time. 4.Considering the facts and circumstances of the case, this Criminal Miscellaneous Petition is allowed and the Petitioners are directed to comply with the conditions imposed by this Court, by order, dated 22.12.2023 in Crl.O.P.(MD) No.23368 of 2023 in Crl.M.P.(MD)No.18148 of 2023 on or before 23.02.2024, failing which, no further extension will be granted.
