CR.NO.246/2022 ... RESPONDENT/COMPLAINANT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition imposed by this Honble Court in Crl.O.P.(MD) No.22614 of 2022 dated 03.01.2023.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SENTHIL KUMAR.A, Advocate for the petitioner and of Mr.M.VEERANTHIRAN, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- This Petition has been filed to relax the condition imposed in Crl.O.P(MD).No.22614 of 2022, dated 03.01.2023 2.The learned Senior Counsel appearing for the petitioner would submit that the petitioner has been working as a Mechanic at Singapore in ZHAO YANG Geotechnic Pvt. Ltd., 2 Tuas Drive 2, Singapore 638637, Tel: (65) 6861 8488 Fax: (65) 6898 4160, Co. Reg. No.199701464D, Website: WWW.zhaoyang.com.sg, for the past 23 years. The incident has also occurred, when the petitioner was at Singapore.

He would further submit that this Court while granting anticipatory bail to the petitioner by order dated 03.01.2023, had imposed a condition that the petitioner shall deposit his original passport to the credit of crime number. In due compliance of the same, the petitioner has also deposited the original passport to the credit of crime number. Now the petitioner has been asked by his employer to return back to work by 20.02.2023, failing which, they will cancel the work pass on 21.02.2023 and thereby, that the petitioner's passport has to be returned and he has to return back https://www.mhc.tn.gov.

CRL MP(MD) No.2478 of 2023 to Singapore. He would further submit that in lieu of the passport being returned, the petitioner is also ready to deposit the original title deed of the property belonging to his mother bearing Document No.3173 of 2007, dated 25.07.2007. Hence, he prays to relax the condition.

3.The learned Government Advocate (Crl. side) has also no objection for allowing this petition.

4.In view of the above, the condition imposed by this Court in Crl.O.P.(MD)No.22614 of 2022, dated 03.01.2023 in conditions 7(b) and (d), are modified to the effect that "(b) the petitioner shall report before the respondent police as and when required for interrogation and (d) the petitioner's passport shall be returned in lieu of the petitioner substituting the same by his mother's original title deed in respect of the property bearing Document No.3173 of 2007, dated 25.07.2007". All other conditions in the said order shall remain unaltered. However, the petitioner shall also furnish his mobile number, E-mail ID and his address at Singapore so as to enable the respondent prosecution to contact him for further progress of investigation.
