PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the Respondents 1 to 4 herein to conduct proper enquiry against the fifth Respondent based on the complaint dated 08.01.2024 having its Reference No.HAD24012611 given by the Petitioner as expedite as possible.

O R D E R

The learned Counsel for the Petitioner submitted that the Petitioner had filed this petition seeking a Writ of Mandamus, to direct the Respondents 1 to 4 to conduct proper enquiry against the fifth Respondent based on the Petitioner's complaint. 2.The learned Counsel for the Petitioner submitted that the Petitioner is the owner of the 12 wheeled Truck bearing Registration No.TN 12 M 8613. While so, the Petitioner received a message from one Velmurugan, who is also a Lorry driver, asking the Petitioner for the 12 Wheeled Truck to pick up the parcel from Sivakasi to Patna. When the son of the Petitioner enquired about the same, the said Velmurugan evaded proper reply. The Petitioner's son handed over the Truck to the fifth Respondent/Velmurugan, subsequently, they could not contact the said Velmurugan. Therefore, the Petitioner had given a complaint 2/5

through online to the Respondents No.2, 3 and 4. 3.The learned Government Government (Criminal side) on instructions from the Respondent Police submitted that the Petitioner had given a complaint to various Police Stations in the same District through online. Till date, they are conducting enquiry. Further, he submitted that they are likely to register an F.I.R. The commencement of the trip had to be obtained by conducting proper enquiry. Only then, they will be able to register the F.I.R and proceed with the investigation. The learned Government Advocate (Criminal side) on instructions from the Respondent Police submitted that they are likely to register the F.I.R within a period of one week.
