Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 323 of IPC r/w. Section 3 of TNPPDL Act in Crime No.360 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2. The case of the prosecution is that when the bus belonging to the Transport Corporation crossed the polytechnic College, the petitioner along with other accused threatened the Driver and Conductor of the bus and quarrelled with them and have also caused damage to the bus.

3. The learned counsel for the petitioner submitted that when the bus belonging to the Transport Corporation crossed the Polytechnic College, without stopping in the bus-stand, the petitioner and others questioned the same and the Driver and Conductor of the bus quarrelled with them, due to which a false complaint has been registered against the petitioner. He further submitted that the petitioner gave a Demand Draft for a sum of Rs.1,500/- in favour of the Managing Director, Tamil Nadu State Transported Limited, Sivagnagai as compensation towards the damage caused by him and he prays for anticipatory bail in favour of the petitioner.

4. Heard the learned Government Advocate (Crl. Side) appearing for the respondent.

5.Considering the facts and circumstances of the case and also considering the fact that the petitioner has compensated the damage caused by him, this Court is inclined to grant anticipatory bail to the https://hcservices.ecourts.gov.in/hcservices/

petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Melur, Madurai District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 08/12/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
