ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.4 & 5, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 395 of IPC, in Crime No.167 of 2014, on the file of the respondent police and hence, seek anticipatory bail. 2.The case of the prosecution is that on 05.06.2015 at about 2.00 p.m., the petitiner and 12 others have entered into the house of the defacto complainant and attacked her and taken away Rs.50,000/- and jewels worth about Rs.2,500/- and threatened the defacto complainant with dire consequences and hence, the present case has been registered for the above said offence.
3.The case of the petitioners is that they are coolies and who are working in the fields where agriculture is conducted. 4.It is submitted by the learned counsel for the petitioners that the petitioners are innocent persons and they have not committed any offence and they have been falsely implicated in this case and pray for anticipatory bail in favour of the petitioners. 5.It is submitted by the learned Government Advocate (Crl.Side) that the co-accused Nos.1,3,7,9 to 13 were already arrested and released on bail and A2 was already granted anticipatory bail and A11 still in custody.
6.Considering the facts and circumstances of the case and also considering the co-accused had already been arrested and released on bail and anticipatory bail, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.I, Thootuhukudi and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10.00 a.m., until further orders. 7.
