For Respondent : M/s.M.Muthu Manikkam, Government Advocate (Ciminal Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.34 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 147, 294(b), 354(A), 323, 506(ii) r/w 379 (NP) of IPC and 4 of TNPHW Act, in Crime No.34 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that when the defacto complainant and the petitioners bathed in the river channel at Avvayar Amman Kovil, Thalakudi, at that time, the petitioners misbehaved with her and when the same was questioned by the defacto complainant's husband, the petitioners abused them in filthy language, assaulted them and also caused injuries. Hence, the complaint.

3.The learned counsel for the petitioners would submit that the petitioners are innocents and not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Criminal Side) appearing for the respondent would submit that the petitioners had misbehaved with the defacto complainant. He would further submit that the offence committed by the petitioners, are serious in nature. 5.Considering the seriousness and gravity of the offence allegedly committed by the petitioners and also the fact that the investigation is pending, this Court is not inclined to grant anticipatory bail to the petitioners at that point of time.
