ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, in Crime No.16 of 2015 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 420, 417, 406 and 506(i) IPC and hence, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is A.1/ A.2 purchased paddy from the defacto complainant and did not pay the amount of Rs.7,75,000/-. Therefore, the defacto complainant has given a complaint for offences punishable under Sections 294(b), 420, 417, 406 and 506(i) IPC, which was registered in Cr.No.16 of 2015.

3. The case of the petitioner is that the defacto complainant is a wholesale paddy seller and the petitioner is only an agent between the defacto complainant and A.2 and the petitioner is nothing to do with the business and he is only introduced A.2 to the defacto complainant.

4. The learned Government Advocate (Crl.Side), on instructions, submitted that after purchasing paddy from the defacto complainant, the petitioner did not repay the amount and both the accused have conspired and cheated the defacto complainant. that earlier this Court, by order dated 14.10.2015, dismissed the Criminal Original Petition in Crl.O.P.(MD)No.18670 and 19559 of 2015 filed by the accused persons.

5. This Court dismissed the earlier petition on 14.10.2015. There is no change of circumstances.Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
