ORDER

This Writ Petition is filed seeking a Writ of Mandamus directing the respondents 1 and 2 to survey the land of the petitioner, which is situated in natham Survey No.78/3, Subramaniayapuram Village, Aranthangi Circle, Pudukottai District, with an extent of 0.04.5 Hectares, by considering the petitioner's representation dated 08.01.2026, within a time stipulated by this

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the third respondent, notice to the third respondent is hereby dispensed with.

4. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject property. The petitioner submitted an application dated 09.12.2025 requesting survey and fixation of the boundaries of the said property. Since the same has not been considered, the petitioner

submitted a representation dated 08.01.2026. Despite the same, the respondents 1 and 2 have failed to take any action, causing undue delay and prejudice to the petitioner. The petitioner, therefore, seeks a direction to the respondents 1 and 2 to conduct the survey and fix the boundaries, within a time frame fixed by this

5. The learned Additional Government Pleader appearing for the respondents would submit that proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the respondents 1 and 2 to consider the petitioner's application dated 09.12.2025, along with the subsequent representation dated 08.01.2026 and demarcate the subject property, after considering the claims of the petitioner, the third respondent and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of sixteen weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
