Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, in *Crime No.438 of 2015 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 365 of the Indian Penal Code read with Sections 511 and 120(b) of the Indian Penal Code and hence, seeks anticipatory bail.
2. The case of the prosecution is that due to money dispute, the accused persons attempted to kidnap the defacto complainant. Hence, the defacto complainant gave a complaint against the petitioner before the respondent police.
3. The learned Government Advocate (Criminal Side) on instructions submitted that already Accused Nos.3 to 9 were arrested and released on bail on 25.10.2015. He would further that Accused Nos.1 and 2 are still absconding.
4. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.VI, Trichy and on his executing a bond for a sum of https://hcservices.ecourts.gov.in/hcservices/
Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily twice at 10.00 a.m., and 05.00 p.m., until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
5.
