O R D E R

The petitioner has come forward with this petition seeking to quash the proceedings in C.C.No.99 of 2009 pending on the file of the learned Judicial Magistrate No.III, Madurai, Madurai District with regard to the petitioner.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.side) appearing for the first respondent.

3. The case of the petitioner is that he is not at all being involved in any of the offence much less the offence mentioned herein. It is brought to the notice of this Court to the report under Section 81 of the Co-operative Societies Act and pointed out that three persons viz., Subburam, Jeyaraj and Perumal are responsible for the misappropriation of Rs.1,48,000/- and that he was the Sub Registrar (Public Distribution https://hcservices.ecourts.gov.in/hcservices/

System), Chinnamanur, Theni District and he is nothing to do with any offence much less the offence mentioned in the charge sheet.

4. The learned Government Advocate (Crl.side) submitted that the petitioner was in-charge of the Society as a Special Officer and that the matter was posted for examination of P.W.4.

5. The case is of the year 2009 and at this point of time, this Court is not inclined to grant the relief sought for by the petitioner. However, the learned Judicial Magistrate No.III, Madurai is directed to take up and proceed with the matter on day-to-day basis and shall not adjourn the matter in working days at any point of time and dispose of the matter as expeditiously as possible.
