O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to disburse appropriate compensation to the petitioner for the land acquired in Survey No.118/5, to an extent of 1 Acre 87 Cents, situated in Kanjirankudi Group, Keelakarai Taluk, Ramanathapuram District, by considering the petitioner's representation dated 13.04.2023 within the period stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that the subject properties belonging to the petitioner were acquired by the Government for the Page No. 2 of 6

purpose of providing free house sites to the Adi Dravida people in the village, despite the petitioner having raised an objection to the same. Though the petitioner challenged the said acquisition proceedings by filing a Writ Petition before this Court and initially succeeded, the same was later reversed by a Division Bench of this Court on the ground that the Writ Petition was filed after the award had been passed and house site pattas had been issued to the houseless persons. Since the award was passed in respect of the said land fixing a meagre amount, the petitioner has not received enhanced compensation. The petitioner submitted a representation dated 13.04.2023 to the fourth respondent. However, the said representation has not been considered. Therefore, the present Writ Petition has been filed.

4. The learned Government Advocate appearing for the respondents, on instructions, would submit that the petitioner's representation dated 13.04.2023 would be considered and appropriate orders would be passed by the fourth respondent within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the fourth respondent to consider the petitioner's representation dated 13.04.2023 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The fourth respondent is also directed to provide a reasonable opportunity of hearing to the petitioner before passing any order. There shall be no order as to costs.
