For Respondent : Mr.E.ANTONY SAHAYA PRABAHAR Additional Public Prosecutor PETITION FOR BAIL Under Section 439 of Cr.P.C. PRAYER :- For Bail in Crime No.46 of 2022 on the file of the Respondent police.

ORDER: The Court made the following order :- The petitioner/A.1, who was arrested and remanded to judicial custody on 28.01.2022 for the offences punishable under Sections 147, 365, 294(b), 323 and 506(2) IPC, in Crime No.46 of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that on 25.01.2022 at about 05.00 p.m., the petitioner and other accused kidnapped the defacto complainant and assaulted him and abused him in filthy language to hand over the jewels, to which the defacto complainant handed over the jewels to the petitioner and other accused. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

4.The learned Additional Public Prosecutor would submit that the investigation is pending and that the anticipatory bail application filed by the second accused was dismissed by this Court vide order dated 09.02.2022 in Crl.O.P.(MD)No.2746 of 2022. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.2910 of 2022 5.Considering the seriousness and gravity of the offence alleged against the petitioner and also the facts that the investigation is pending, that the anticipatory bail application filed by the second accused was dismissed by this Court and that the accused 3 and 4 are still in judicial custody, this Court is not inclined to grant bail to the petitioner.
