ORDER : The Court Made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 26.10.2015 for the alleged offences punishable under Sections 290, 447, 353, 309 of I.P.C and Section 3 of TNPPDL Act and Section 7(1) of Criminal Law Amendment Act, in Crime No.730 of 2015 on the file of the respondent police and hence, seeks bail. 2.The case of the prosecution is that on 26.10.2015 the petitioner/accused caused public nuisance and climbed in a cell-phone tower and disturbed the public servants from discharging their duty and threatened that he will commit suicide and tried to damage the cellphone tower.
3. The case of the petitioner is that the petitioner is an exservice man. After his retirement, he did not receive the retirement benefits and he is finding it difficult to lead his life and no-one is available to look after his family. He further submitted that the petitioner in an innocent person and he may be granted bail.
4. The learned Government Advocate(Crl. Side) on instructions submitted that the petitioner is aged about 38 years and he threatened the public servant that he will commit suicide.
5. Considering the facts and circumstances of the case and also considering the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Kovilpatti, Thoothukudi District and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., and 5.00 p.m., for a period of two weeks and thereafter he shall appear before the respondent police daily morning at 10.00 a.m., until further orders.
