ORDER

The petitioner seeks for issuance of a Writ of Mandamus to direct the first respondent to accept his request to surrender his gun, namely, 12 bore S.B.B.L license number 611/D.M to Tamilnadu Government, based on his representation dated 08.01.2024.

2. Mr.SRA.Ramachandran, learned Additional Government Pleader takes notice for the respondents 1, 2 and 4. Mr.S.S.Mathavan, learned Government Advocate (crl. side) takes notice for the third respondent. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. The petitioner had been serving in Indian Army for 16 years and he retired on 31.10.2009. At the time of his service, he had a gun with license, which is valid through out India. His gun license expired on 31.12.2008. 2/5

Hence, in December 2008, he applied for renewal of his gun license before the District Magistrate, Jhansi (U.P State), who was issued the said license. However, it was not renewed for the reason that he is residing in Tamil Nadu. Thereafter, he has not applied for renewal. Now, he has decided to surrender his gun. Therefore, he sent a representation to the first respondent requesting him to accept his gun. Since the said representation has not been considered so far, he filed the present writ petition.

4. The learned Additional Government Pleader appearing for the respondents 1, 2 and 4 would submit that the representation of the petitioner will be considered by the first respondent in accordance with law.

Considering the limited scope of the prayer sought for by this petitioner, this Court, without going into the merits of the claim made by the petitioner in this Writ Petition, directs the first respondent/District Collector to pass appropriate orders on the representation of the petitioner, dated 08.01.2024, on merits and in accordance with law, after giving notice to the interested parties, if any, within a period of six weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition stands disposed of. No costs.
