Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 406 and 420 of IPC in Crime No.309 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.
2. The case of the prosecution is that the de facto complainant pledged jewels with M/s. Muthoot Mercantile Bank Limited and borrowed a sum of Rs.3,38,300/-. Before the expiry of one year, without informing the de facto complainant, A2, who is the Branch Manager of the M/s.Muthoot Mercantile Bank Limited, sold the jewels, as per the instructions of the petitioner / A1.

It is submitted by the learned counsel for the petitioner that the petitioner was working in the Indian Air Force for a period of 20 years and after his retirement, he was joined as a Regional Manager in the above said Bank and his duty is only to supervise the work of the employees. He further submitted that petitioner is an innocent person and he is nothing to do with the offence as alleged in the prosecution that the jewels were sold, as per the instructions of the petitioner and prays for anticipatory bail in favour of the petitioner. 4.It is submitted by the learned Government Advocate (Crl.Side) the investigation of the case is pending.
5.Considering the nature of allegations made against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate-V, Madurai District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on https://hcservices.ecourts.gov.in/hcservices/
further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
