O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second and third respondents to measure the property in S.Nos.109/2A and 109/3, totally measuring an extent of 15 acres and 95 cents, situated at Nochiyurani Village, Ramanathapuram Taluk and District, on the basis of the UDR sketch and A-Register, by considering the petitioner's representation dated 22.01.2026.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that a representation has been submitted for the survey of the property in question and for demarcation of its boundaries.

4. The learned Additional Government Pleader appearing for the first to third respondents would submit that the petitioner is seeking Page No. 2 of 5

survey based on the old UDR and that there is a new UDR, based on which the survey can be conducted, after consideration of the claims of the parties, in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, subject to the petitioner paying the necessary survey fee.

5. In response to the above submission, the learned counsel for the petitioner would submit that unless the survey is conducted based on the old UDR, the survey cannot be conducted properly.

In view of the above, this Court directs the second and third respondents to consider the petitioner's representation dated 22.01.2026 and subject to the petitioner paying the necessary survey fee, if the same has not already been paid, to survey and demarcate the petitioner's land after conducting an enquiry and considering the claims of all parties, including the private respondent and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of sixteen weeks from the date of receipt of a copy of this order. All necessary documents for the purpose of conducting the survey shall be looked into. In the event of any rival claims, the parties are Page No. 3 of 5

at liberty to pursue their remedies before the Civil Court. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners, the private respondent and other interested parties, if any.

7. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
